The judge granted the motion for a new trial, but reserved some opprobrium for the casino for failing to properly investigate the two photographs in the first instance.<\/p>\n
\u201cHad Bellagio timely discovered this issue \u2014 and there is no reason it could not and should not have done so during the discovery period \u2014 a second trial would not be necessary,\u201d he wrote. \u201cIt is difficult to understand why Bellagio did not pursue this during discovery, given that each side\u2019s story about the photograph was directly contradictory.\u201d<\/p>\n
